PAYMENT AND CANCELLATION POLICY

Your deposit guarantees your spot on the workshop. If you wish to protect expenses you have invested in the workshop such as flights and lodging, I highly recommend purchasing travel insurance. It is a very affordable and widely available way to protect your purchase in the event of unforeseen circumstances. You can find a list of providers by clicking here.

The total cost payable to TJ Thorne Photography LLC for any given Landscaping and Nature Photography Workshop (the “Workshops”) is listed directly on the webpage for each individual Workshop as the “Tuition”. Tuition for all Workshops are subject to the terms of this Payment & Cancellation Policy, as well as the Terms & Conditions provide on this website.

Tuition for each Workshop will be paid in one of two methods: (1) In full upon registration; or (2) through a deposit made at the time of registration and the remaining Tuition balance due no later than forty-five (45) days prior to your Workshop’s start time. If full Tuition is not received by the date that it is due, TJ Thorne Photography reserves the right to cancel your reservation and retain any deposit or payments made toward your Tuition.

Should you need to cancel your registration for any reason, you must send a notice of cancellation to TJ Thorne Photography in writing, which will become effective as of the date sent (i.e., the date postmarked for standard mail, or the date/time sent for electronic communications).

    1. Where notice of cancellation is received by TJ Thorne Photography more than ninety (90) days before the start of the Workshop, any payments made can be refunded minus a $100 administrative fee.
    2. Where notice of cancellation is received by TJ Thorne Photography forty-five (45) to ninety (90) days before the day your Workshop begins, you shall forfeit your deposit (for Workshops where a deposit is required) but shall not be liable for the remaining tuition balance. 100% of your deposit made can be credited to an alternative Workshop run solely and exclusively by TJ Thorne Photography within 365 days from the date of cancellation.
    3. Where notice of cancellation is received by TJ Thorne Photography less than forty-five (45) days before your Workshop begins, you shall forfeit your entire Tuition and no refund will be given, though 100% of your payment made can be credited to an alternative Workshop run solely and exclusively by TJ Thorne Photography within 365 days from the date of cancellation.
    4. If a cancellation ninety (90) days or less before the start of the workshop is filled from the waiting list, a full refund can be offered minus a $100 administrative fee. If you do need to cancel, we ask that you let us know as soon as possible so we can alert people on the waiting list.
    5. In the rare event that a Workshop is cancelled by TJ Thorne Photography due to unforeseen circumstances, you will receive a credit toward a future workshop. It is recommend that you avoid purchasing non-refundable airline tickets, and consider purchasing trip cancellation insurance.

TERMS AND CONDITIONS

Thank you for choosing to participate in a photography workshop with TJ Thorne Photography LLC. TJ Thorne Photography LLC is referred to below as “TJ Thorne Photography”, and you may periodically be referred to below as the “Client”.

By signing up for a Landscaping and Nature Photography Workshop, you agree to the Terms and Conditions set forth below:

  1. Service. The date, location, and Tuition for your specific Landscaping and Nature Photography Workshop (the “Workshop”) shall be those set forth on the webpage for your Workshop (the “Webpage”). During the Workshop, TJ Thorne Photography shall provide in-field photography instruction and location guidance as detailed on the Webpage (the “Services”). While lodging, food and transportation recommendations will be made whenever possible, TJ Thorne Photography does not provide, and bears no responsibility for providing, transportation, lodging, or meals during the Workshop.
  2. Tuition; Method of Payment. The total cost payable to TJ Thorne Photography for the Services provided during the Workshop shall be the amount stated on the Webpage as the “Tuition”. Depending on your Workshop, Tuition is paid either: (1) in full upon registration, or (2) through a non-refundable deposit made at the time of registration, with the remaining Tuition balance due no later than forty-five (45) days prior to your Workshop. If full tuition is not received by the date that it is due, TJ Thorne Photography reserves the right to cancel your reservation and retain any deposit or payments made toward your Tuition.
  3. Cancellation by Client; Refund. Should you need to cancel for any reason, you must send a notice of cancellation to TJ Thorne Photography in writing, which will become effective as of the date sent (i.e., the date postmarked for standard mail, or the date/time sent for electronic communications).

  4. Cancellation by TJ Thorne Photography. TJ Thorne Photography reserves the right to cancel the Workshop due to inadequate enrollment that makes the Workshop economically infeasible, or because of good-faith concerns with respect to safety, health, or welfare of participants. Cancellation decisions shall be made in the sole and absolute discretion of TJ Thorne Photography. If a Workshop is canceled prior to commencement, you will be given a credit in the amount of all tuition paid for the Workshop. If a Workshop is canceled in progress, you will receive a prorated refund based on the number of days (or hours for one-day workshops) not completed.
  5. Travel Insurance. TJ Thorne Photography strongly encourages all Clients to purchase travel insurance for your Workshop in order to protect you and your investment in the event of a sudden emergency before or during your Workshop, and coverage for trip cancellation or interruption, illness, injury, damage , and loss or theft of baggage, as well as emergency assistance.
  6. Pandemic and Infectious Disease Outbreak. Any Workshop adversely impacted by an infectious disease outbreak or any other epidemic or pandemic designated by the Centers for Disease Control and Prevention (CDC) and/or the World Health Organization (WHO), such as COVID-19 (an “Infectious Disease Event”), may be canceled or postponed in the sole and absolute discretion of TJ Thorne Photography.
    1. If your Workshop is postponed or canceled due to an Infectious Disease Event forty-five (45) days or more before the Workshop begins, you will be given the option of (1) applying any Tuition paid toward a future scheduled or to-be scheduled workshop run solely and exclusively by TJ Thorne Photography; or (2) receiving a full refund of any Tuition that has been paid beyond the non-refundable deposit.
    2. As a small business in the global travel industry, TJ Thorne Photography is greatly affected by global outbreaks such as COVID-19, and we cannot provide mass refunds where an Infectious Disease Event results in the cancellation of a Workshop less than forty-five (45) days before the Workshop begins. Unfortunately, there will be no exceptions to this ‘no-refund policy’ in the case of an Infectious Disease Event.
  7. Force Majeure. Neither party shall be in breach nor liable for delay in performing or failure to perform if such delay or failure results from events, circumstances or causes beyond their reasonable control, including but not limited to: natural disasters or acts of God; acts of terrorism; government acts, closures or orders; epidemics, pandemics, outbreaks of communicable disease, or other public health crises; quarantine; national or regional emergencies; or any other event out of the parities’ control, whether similar in kind to the foregoing or otherwise (“Force Majeure Event”). Written notice of a party’s failure or delay in performance due to a Force Majeure Event must be given to the other party no later than five (5) business days following the Force Majeure Event commencing, which notice shall describe the Force Majeure Event.
  8. Photographs by TJ Thorne Photography & Use of Likeness. TJ Thorne Photography reserves the right to take photographs and videos during the operation of any Workshop and to use the resulting photographs or videos during the operation of any subsequent Workshop or for commercial or promotional purposes, and you agree to allow your likeness to be used for those purposes without compensation. You grant TJ Thorne Photography a non-exclusive worldwide irrevocable license to use those videos or photographs for editorial, promotional, and training purposes. However, Copyright to all photographs and videos that you take during the Workshop shall belong to you. If you prefer that your likeness not be used by TJ Thorne Photography, you must notify us in writing prior to commencement of your Workshop.
  9. Assumption of Risk; Release of Liability; Indemnification. You acknowledge that the Workshop and outdoor adventure photography in general carry an inherent risk that cannot be controlled or limited by TJ Thorne Photography. You therefore freely assume all risk associated with the Workshop as well as other risks that cannot be predicted, and any harm, injury or loss that may occur to you or your property as a result or your participation in the Workshop. You agree to release TJ Thorne Photography and its agents from all liability, causes of action, claims and demands that arise in any way from any injury, death, loss or harm that occur to you or to your property during the Workshop, including claims for negligence of TJ Thorne Photography. You also agree to indemnify, hold harmless and defend TJ Thorne Photography against any and all claims by third parties arising out of any acts committed by you, including acts of negligence, during the Workshop.
  10. No Warranty. TJ Thorne Photography gives no warranty, express or implied, or of fitness for a particular purpose, in connection with the Workshop. TJ Thorne Photography makes no warranty whatsoever with respect to any intended results that Client expects to derive from the Services. TJ Thorne Photography’s sole warranty is that it will use commercially reasonably efforts to perform its obligations and the Services as defined herein and on the Webpage.
  11. Miscellaneous Provisions.
    1. Attorney Fees. In the event that suit or action must be instituted by TJ Thorne Photography to enforce any provisions hereof or to collect any Tuition owed, TJ Thorne Photography shall be entitled to recover from Client any attorney fees or other costs associated with such suit or collection action.
    2. Amendments. These Terms and Conditions may be amended by TJ Thorne Photography at any time and said amendment’s will be posted on the website of TJ Thorne Photography and Client will receive notification of any such changes.
    3. Governing Law; Venue. All claims or causes or action (whether in contract, tort or statute) that may be based on, arise out of or relate to the Workshop, shall be governed by, and enforced in accordance with, the internal laws of the State of Oregon, including its statues of limitations. The sole and exclusive jurisdiction of any suit related to or arising out of the Workshop shall be the Clackamas County Circuit Court in Oregon City, Oregon. Client waives any objection to jurisdiction and venue which Client may otherwise have to this venue for any such lawsuit.
    4. Assignment. TJ Thorne Photography may assign or transfer any of its right or obligations without Client’s consent. Client may not assign its rights hereunder, and any assignment shall be void and result in an automatic cancellation of Client’s reservation.
    5. Breach & Damages. Under no Circumstances shall TJ Thorne Photography be liable to Client for any special or consequential damages, including but not limited to travel expenses or airfare. In the event of a breach by TJ Thorne Photography, Client’s sole and exclusive remedy shall be a refund of any Tuition paid.

      FREQUENTLY ASKED QUESTIONS

      What happens during inclement weather?

      Sometimes unexpected weather patterns do arise and what some people consider to be suboptimal conditions, we as photographers embrace them, change our thinking, and strive to use those conditions to our advantage. However, sometimes conditions can be downright nasty and unfavorable. In this case, we will supplement with processing instruction, image/portfolio critique, alternate nearby locations (if possible), or rest. Be prepared for a variety of weather conditions. Information regarding weather preparation specific to your workshop will be provided with workshop materials prior to the start of the workshop.

      Will I need to provide my own transportation, lodging, and food?

      My workshops include in-field instruction, location guidance, and in some cases, a recorded video of the provided processing instruction. Flights, lodging, rental cars, and meals are not included. For nearly all of my workshops I opt to camp and you can take advantage of this option as well. For most workshops, a group rate is secured for recommended lodging and will be provided prior to the workshop.

      If you wish to carpool or share rooms with other students, please let me know as early as possible and I will put the word out to see if others are interested.

      For most workshops breaks for lunchtime will be provided. It is highly advised that you eat breakfast before the daily meet-up time and carry snacks with you. We prioritize photographing these amazing locations and maximizing our shooting opportunities, and in some cases we could be a significant distance away from amenities.

      Can I bring a guest?

      Most workshops are limited in group size due to permits. As such, I am not able to offer discounts for guests who will not be photographing. They can still participate, witness the amazing scenery, benefit from the guiding, and join all group activities. In some rare instances I will allow a non-photographing guest of at least 18 years old to join at a 50% discount. Please inquire if interested.

      For your Oregon Coast Workshop, you say that we will find lodging wherever we end up that night. Is this ever a problem?

      During the times of the year that I run Oregon Coast Photography Workshops, it is considered the off season for tourism. We photographers are an anomaly. There has never been an issue finding lodging and I suggest using the Priceline mobile app (or equivalent) to find better pricing with their ‘last minute’ and mobile deals. This just helps save a few dollars here and there as opposed to just walking into the establishment. There are also plenty of camping opportunities, which is what I, myself, most often opt for.

      Why should I choose your workshops over the others available?

      I know that there are many photography workshops out there and that it can be hard to choose. When you take one of my workshops you are receiving my highest level of attention and service. From initial communication to well after the workshop ends, I am dedicated to helping you achieve your photographic goals. I am not a passive guide or teacher. I am there every step of the way making sure that you are aware of the hazards present and to lend a helping hand or steady boost. My priority is getting you in the right places at the right times SAFELY. I understand that each client has different needs and I approach each individual based on their preferred learning style. I communicate in clear and thorough ways that are easy to understand. My personality is laid-back, approachable, and supportive. I’ve had clients of all kinds: from Iron Man types to clients with mobility concerns and I'm certain that they would tell you that I made it work, took care of them with care and patience, and got them in situations where others haven't been able to. Some clients, if they were comfortable, I've helped push through their fears head on and many of these clients have taken multiple workshops with me. YOU are my priority, not my own photography and I will drop whatever I’m doing to answer your questions or cater to your needs.
